Body Description:	The Mental Health Court is established under the Mental Health Act 2016 (the Act). The Court decides the state of mind of people charged with criminal offences and whether an alleged offender was of unsound mind when they committed an office as well as their fitness for trial. The Court is also the appeals body for decisions made by the Mental Health Review Tribunal. It is constituted by a Supreme Court Judge who is assisted by one or two clinicians. Assisting clinicians are appointed by the Governor in Council on the recommendation of the Minister for Health.
